The importance of ensuring Work, Health and Safety (WHS) Compliance 

For local government bodies, adherence to Safe Work legislation is paramount. Recent updates to Work, Health and Safety (WHS) laws serve as a reminder to employers across all sectors of their duty to promote a safe work workplace for employers, contractors and volunteers. 

Cases such as SafeWork NSW v Camden Council, heard in 2021, emphasise the importance of WHS compliance. The case concerned the death of one volunteer and injury of another, as they laid pipes for a water system at The Men’s Shed, located in Camden Bicentennial Equestrian Park. 

Three years prior to the incident, the council commissioned an independent risk assessment of the site, which raised multiple safety issues for volunteers. A year later, the Council’s internal team audited the location and advised against the use of volunteers in select locations. 

Despite the warnings, there was nobody present during the 2018 waterworks project to oversee and ensure WHS requirements were followed. No risk assessment was conducted, either. 

Following the trial, the council sustained a penalty of $1 million. 

A Timely Reminder 

This case acts as a reminder for local councils and other government organisations to ensure they are taking reasonably practicable steps to protect health and safety of not only employees, but also contractors, volunteers, and anyone else to whom they owe a duty.
